Terms of Service
Last updated: {{date}}
These terms govern your use of IRMAA Appeal ("the Service"), independent self-help software operated by Owusu LLC ("we", "us"). By using the Service or buying the appeal pack, you agree to them.
What the Service is
The Service helps you prepare Form SSA-44 (Medicare Income-Related Monthly Adjustment Amount – Life-Changing Event) and related documents from the information you enter. It:
- works out, for free, whether your situation is one Form SSA-44 can address;
- estimates the Medicare surcharge an appeal might remove, using the published IRMAA tables; and
- for a one-time payment, prepares a filled Form SSA-44, an evidence checklist, a cover letter and a filing guide for you to review, sign and submit yourself.
What the Service is not
The Service is not the Social Security Administration, the Centers for Medicare & Medicaid Services, the Internal Revenue Service, or any government agency, and is not affiliated with or endorsed by any of them. It is not legal, tax, accounting or financial advice, and we are not your attorney, accountant or financial adviser. For advice about your particular situation, consult a qualified professional.
We do not submit anything to Social Security for you, do not contact Social Security on your behalf, and never ask for your Social Security or my Social Security login. You are responsible for reviewing every document, signing it, and submitting it yourself.
Social Security makes the final determination. We do not decide your premium, and we cannot and do not guarantee that an appeal will succeed, that a surcharge will be reduced or removed, or that any estimate will match Social Security's result. Estimates are based on the information you provide and the published IRMAA figures, which can change.
Your responsibilities
You agree to provide accurate information, to review the prepared documents for accuracy before submitting them, and to use the Service only to prepare your own appeal (or one you are authorized to prepare). You are responsible for meeting any deadlines that apply to your situation.
Payment
The appeal pack is a one-time payment, shown before you pay, with no subscription. After payment you can edit your answers and download your documents again at any time while the Service is available. Your name and Social Security Number are locked to the appeal you purchased; other answers remain editable.
Refunds
Because the pack is digital content delivered immediately, payment is generally final once you have downloaded your documents. If the Service failed to deliver what it describes, contact us and we will make it right, including a refund where appropriate.
Limitation of liability
To the fullest extent permitted by law, the Service is provided "as is", and our total liability for any claim relating to the Service is limited to the amount you paid for it. We are not liable for any indirect or consequential loss, or for any outcome of a submission to Social Security.
